W: I am the Director Legal Services NITDA

Ikwueto: You came here on subpoena

W: I received a subpoena this morning when I walked into my office

Ikwueto: Do you have it here

W: No I don’t

Ikwueto: Well this is a copy, look at it

W: Yes, this is what I got this morning There’s no objection to the subpoena from the respondents.

Ikwueto: The subpoena commanded you to produce 3 documents. Where is it

W: I don’t have it Ikwueto:

The Documents sent by NITDA to INEC requesting Payment

W: We don’t have it in our office Ikwueto: Okay. What of the Certificate of Clearance issued by NITDA to INEC pursuant to the 1st document

W: We don’t have that document Ikwueto: You don’t have it

W: We don’t Ikwueto: Okay. What about the report submitted by INEC to NITDA on Request of BVAS and the electronic transmission

W: We don’t have that document in our office to the best of my knowledge Ikwueto: You don’t have it or it doesn’t exist

W: We don’t have it Sir

Justice Tsammani: Cross examination

INEC: My lord I object to this witness standing as a witness. It is not constitutional.

INEC: I can see the smile on Ikwueto and I know he will have a good weather talking about this witness, so I have to object. There is no statement for this witness

Justice Tsammani: Mahmoud this witness is on subpoena and he doesn’t need that please. You know the law

Olanipekun: We object to the witness, we didn’t say we won’t cross examine. I know you very well

W: He is Kashifo Inuwa Abdullahi CCIE and he’s the DG

O: You got this subpoena today

W: Yes

O: I suggest to you that you don’t have the authority of your DG to be here It was addressed to me personally and that is why I am here

O: So you don’t have the authority of your DG to be here I don’t understand your question

Olanipekun now on the top of his voice: So do you have the authority of your DG to be here

W: I did talk to him about the summons and he said I should come here. So I am here on his approval. The whole courtroom is now murmuring heavily

O: You have an act 2007

W: Yes O: Have you read it

W: Yes

O: Is there any certification on the act that refers to ISO 27001-2013 I put it to you that there is nothing like that

W: The act does not contain cybersecurity standards Hmmmmmm this question has to do with the previous witness

O: There is no provision in your ACT that mentions the INEC

W: Our ACT doesn’t mention any Agency

O: That would be all APC is now up.

APC: Do you know the Ministry of Communication

W: Yes

APC: Are you aware the minister said they had 16 million attempts to hack INEC on the presidential election day

W: Yes I am aware he made that statement

APC: So are you aware he said NITDA was the source of that information W: Yes I am aware

APC: I like you, you are a lawyer. You are aware INEC is an independent body W: I don’t understand your question APC: You are a lawyer, you don’t know what independent is.

INEC should be independent in the election

Livy: In Paragraph 36 you made mention of a Press Release signed by Festus Okoye of INEC

W: Yes Livy: Can you identify it

W: Yes Livy: That evidence is already in court So on page 20, you stated you can identify all forms EC8A-E and all INEC Electoral document INEC cuts in

INEC: My lord, I just want to confirm how many minutes this witness has

Justice Tsammani: He’s a star witness, he has 30 minutes and then you all have 20 minutes each to cross examine him Olanipekun cuts in: My lord this witness has used more than 30 minutes, it’s over 40 minutes now All the baby lawyers behind Olanipekun are shouting yes yes yes Olanipekun: My lord, subject to the time keepers we are also looking at it
