Enugu Judgement today Vs The Actual Law

Enugu State Tribunal Ruling On Peter Mbah’s Certificate Forgery In PRP’s Petition Vs. What The Law Says:

Tribunal Judgment:

“The Tribunal chaired by Justice Kudirat Murayo Akano on Thursday held that the petitioner [PRP] failed to prove that the respondent [Peter Mbah] did not possess the minimum requirement to stand for election which is a school certificate or its equivalent.”

Position of the Law:

According to Section 182 (1)(j) of the 1999 Constitution (As Amended): (1) “No person shall be qualified for election to the office of Governor of a state if… (j) he has presented a forged certificate to the Independent National Electoral Commission.”

The law did not say the certificate must be one of the minimum requirements to run for office of the governor. It says any certificate. PEPT scenario is at play at Enugu State.

Big Question. :

Did the petitioner challenge the respondent’s minimum qualification for governorship position 🤷🏽‍♂️?
